Regulatory Update

HMO rooms now let on APTs, not ASTs.

Under the Renters' Rights Act and the Government's implementation from 1 May 2026, Assured Shorthold Tenancies (ASTs) have been abolished in England. Every HMO room-let is now issued under the new Assured Periodic Tenancy (APT) framework - referred to legally as an "assured tenancy" operating on a periodic basis.

Existing HMO ASTs converted to APTs on the implementation date unless they fell within specific transitional arrangements. Section 21 "no-fault" evictions no longer apply; possession from an HMO room now proceeds under Section 8 only, using the statutory grounds - including rent arrears, anti-social behaviour, and the other prescribed grounds.

For HMO operators this raises the bar on paperwork, licence-condition compliance and record-keeping. Every tenancy in every room we manage is drafted, renewed, and served under the current APT / Section 8 regime.
